Changed soil conditions claim where piles
were required to be driven to excessive depths. Piles were also required to be driven to excessive capacity by the owner’s engineer.
I was an expert and fact witness for Raymond International. Extra compensation was
paid to Raymond.

ISLA DEL SOL - GALVESTON, TEXAS

Lawyer was Mark Thayer with Barry G. Flynn and Associates.
The case involved loss of fill and cratering behind a concrete panel bulkhead for a residential subdivision. Each house had frontage on the bulkhead. The contractor had done a poor job of installing filter fabric at the joints between the concrete panels and at the weep holes through the panels. The backfill was fine sand, and it easily ran out wherever the filter fabric was missing. I represented the engineer and the owner in a deposition.

Faulty concrete foundation construction for heavy printing equipment led to serious alignment problems. In the equipment. The foundation cracked and settled differentially. No deposition; three hours of trial testimony in Houston District Court.

CRUISE SHIP TERMINAL - FREDRICKSTED, ST. CROIX, U.S.
VIRGIN ISLANDS


Arbitration hearings in local courtroom in Fredricksted. I have about 12 hours of expert testimony in favor of the contractor, Balfour Beatty. I was a fact witness as well as an expert witness since I was involved with the project from the bid and through the construction. This was a changed soil conditions claim. The soil borings showed all sand soils throughout the alignment whereas about half of the alignment was underlain by hard cemented coral and massive sand. The concrete cylinder piles had to be predrilled and grouted instead of being driven as planned. The contractor was awarded
$1.25 million.

JAMESTOWN BRIDGE - JAMESTOWN, RHODE ISLAND ATKINSON-KIEWIT - J.V. VERSUS STATE OF RHODE ISLAND

Heavy steel H-piles driven inside 54" O.D. concrete cylinder piles encountered numerous cobbles and boulders in sand deposits which were shown by the borings to be clean sands. Changed soil conditions claim leading to excessive delays in construction. $58 million claim. I was part of the formal claim presentation team.

NIPSCO COOLING WATER LINES COLLAPSE
NIPSCO ET. AL. VERSUS THATCHER CONSTRUCTION CO ET. AL.

Small contractor installing tow small sheet pile cofferdams accidentally caused the collapse of two 14-foot diameter cooling water lines which led to about $50 million damages to the power plant and subsequent loss of service for over a year. I was an expert witness for the contractor. I had a three day deposition lasting about 30 hours total. Case was settled out of court.

SMIT AMERICAS VERSUS SAMEDAN OIL COMPANY

Offshore drilling platform - Delmag D-100 hammer driving 48" O.D. x 600 foot long pipe piles. One pile refused due to excessive delays and consequent soil freeze capacity. I represented SMIT AMERICAS as an expert witness. I had three days deposition testimony as well as a series of expert reports. Case dropped due to misrepresentation of hammer energy by supplier.

SMIT AMERICAS VERSUS PILECO

Continuation of 9616. Misrepresentation of hammer ram weight of Delmag D?100 and rated energy of same was a major contributing factor to the refusal driving of the pile in the previous case. I again represented SMIT AMERICAS as an expert. Two days deposition testimony.

PORT OF CORPUS CHRISTI VERSUS T. L. JAMES DREDGING COMPANY

T. L. James dredged too close to Wharf No. 9 in the Port of Corpus Christi. Some piles were broken and the slopes under the wharf were undermined.
I gave a deposition as an expert witness for the Port of Corpus Christi.

WALLISVILLE RESERVOIR
HELDENFELS ENTERPRISES VERSUS CORPS OF ENGINEERS

Heldenfels alleged faulty design and installation procedures on the Port of the Corps of Engineers. The Corps of Engineers claimed that the concrete sheet piles were improperly fabricated and stored. I testified as an expert witness for Heldenfels Enterprises in a formal arbitration hearing.

WATERFORD HARBOR - CLEAR LAKE, TEXAS

Mark Guthrie - Lawyer, Winsted Sechrest and Minick.
Slope failures after heavy rains caused bulkhead failures. I am an expert witness and a fact witness for the owner of Waterford Harbor. This is an active case and will involve depositions and possibly trial testimony.
